PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY

1. Services Provided

Social5 will provide you with the services listed on the landing page that led you to this online signup. If you have any questions about your services, please revisit the landing page for more details.

2. Service Term and Payments

Annual Service Programs - You agree to a one-year term of service. After a year, this agreement will auto-renew unless you elect to opt out of the service. Your Social5 services are paid for annually upfront.

Monthly Service Programs – Your services will be billed monthly upfront and will continue for as long as you are on the service.

Monthly Service Programs with a Term Commitment – Your services will be billed monthly upfront and will continue for the duration of the term specified. After fulfilling your term commitment, your services will continue on a monthly basis.

All Social5 services require upfront payment and all payments are non-refundable. If you desire to cancel service after you have completed your service term, you agree to give Social5 a 30-day notice in writing for the cancellation. By agreeing to these terms and submitting your credit card information for payment, you agree to have Social5 bill upfront for payment and acknowledge that all payments are non-refundable.

3. Security, Password and Confidentiality

Social5 does not sell your lists or share your information. This means that no third-party has access to your personal account information, subscriber details, or contact list. State-of-the-art 128-bit SSL encryption and secure data connections protect your data while in transit. Social5 does not store credit card numbers. Social5 does not store personal information about your contacts — only email address and historical email delivery records. Social5 also stores any optional information (name, phone number, notes, etc.) explicitly provided by you or your contacts. Your client contact data are encrypted and passed via Secure Sockets Layer (SSL). All information is housed offsite in undisclosed, physically secure locations.

If you use a password to access any site associated with your services, then you are responsible for maintaining the confidentiality of the password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur on your account or with your password. In the event that the confidentiality of your account or password is compromised in any manner, you agree to notify Social5 immediately. Social5 reserves the right to take any and all action, as it deems necessary or reasonable to maintain the security of your account, including without limitation terminating your account, changing your password, or requesting information to authorize transactions on your account. While Social5 takes prudent steps to protect your account and any related sites, it cannot protect your information outside of the site. For example, when Social5 communicates with you via unencrypted email from time to time at your request, the communication is not secure, is not stored securely, and the information contained may be viewed by others. You acknowledge that by requesting information by email, you agree that Social5 may transmit it to you from time to time and store it in an unencrypted form and manner. Social5 may rely on the authority of anyone accessing your account or using your password and in no event will Social5 be held liable to you for any liabilities or damage resulting from or arising out of (i) any action or inaction of Social5 under this provision; (ii) any compromise of the confidentiality of your account or password, or (iii) any unauthorized access to your account or use of your password.

4. Intellectual Property

Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs, video clips and written and other materials that are part of this site (collectively, the "Contents") are copyrights, trademarks, trade dress and/or other intellectual property owned, controlled or licensed by Social5, one of its affiliates or by third parties who have licensed their materials to Social5, and is protected by U.S. and international copyright laws. The compilation (meaning the collection, arrangement, and assembly) of all content on this site is the exclusive property of Social5 and is also protected by U.S. and international copyright laws.

5. Submissions

If you enroll (or have enrolled) for service using this site, you agree that any information you provide to Social5 will be current, accurate and complete. You also agree that you are an authorized individual to enlist the services of Social5 or modify and adjust services on behalf of the customer. You agree that any materials, including but not limited to questions, comments, suggestions, ideas, plans, notes, drawings, original or creative materials or other information, provided by you in the form of email or submissions to Social5, or postings on this Site ("Submissions") are non-confidential (subject to Social5’s Privacy Statement) and that you remain solely responsible and liable for your Submissions.
